Court of Appeals Hand down 9/8

There were two reported criminal decisions on Tuesday.  The first, Davis v. State was a typical PCR that was denied by the trial court and affirmed by the Court.  The second was Lewis v. State, a simple possession of controlled subtances case, with the updated “momentary possession” defense.  Lewis felt that since he only had the crack momentarily, he wasn’t guilty.   As would be expected, the Court did not buy the argument.
